In Romania 2022 is the new 1984 

The Senate of Romania just passed a new law that forces all internet and telecom providers to record all encrypted and un-ecrypted traffic, on their cost, and also provide a way for the Romanian Intelligence Service to extract the data "as needed".

The new 100 page law was provided for review 10 minutes before the session and it was passed after 30 minutes of "debate". But there is good news...

The good news is the fact that the law will be challenged at the Constitutional Court of Romania and probably it will never be applied.

Experts say it has many issues, but the most obvious one is that they've used words that don't exist in the Romanian language.

They've probably used to get the translation for "encrypted" and they got a word that doesn't exist in our language: "cripat".

@cjd, no, they are just incompetent and my hunch is that they didn't read relevant papers and ended up using some slang words that a geek might use on the internet, instead of using actual words that officially exist in our language.

And of course, if you find anything on the internet, it must be true so... they've just used the wrong technical words.

Yes, because AT&T doesn't care about their customers' privacy and the NSA offers them money. Probably also threatens to call the IRS and have them audited if they don't play ball, this is a thing.

@redchrision can you take a look at the text and tell us if this law was originally written in Romanian or if it's a shoddy translation?

If lawmakers are voting for bills which were slipped under the door by foreigners then there's a big problem.

Uhm, that problem might be "harmonization" of the lawmaking process in the EU. Look at
european data retention directive.

The step from "metadata" to "complete record of all packets" is small, was tried and will be tried again and again in the future IMHO...

@cjd, as I saind in the other thread, it's probably just a botched translation on their part.

The current prime minister is a retired military general that participated in the Bosnian, Afganistan and Iraq wars:

@walter who is the telcom provider in they eyes of the law in Romania? Recently i heard from my lawyer that telcom's arent just anyone providing services on internet so most libre/fedi hosters arent consider telcoms (at least not in nl).

@muppeth, I actually have no idea what makes a telecom provider.

I'm still waiting for a good summary and explanation; because I don't legalese and it's a pain to read any of those documents, you have to really know how to read them.

@walter Sweden introduced this many years ago and sadly has no real constitutional court.

@clacke, I've heard that they have a similar law in Denmark, there was something it beings against an EU directive, but I don't know the details or if it is true.

@walter how can an ISP provide a way to extract the data that has been encrypted by any app not under the control of the ISP?
